Welcome to Roaya Gulf. These terms and conditions govern your use of our website, applications, and services (collectively referred to as the “Platform”).

By using the Platform, you agree to be bound by these terms, which constitute a legally binding agreement between you (“the User”) and Roaya Gulf Information Technology Company (“the Company”).

  • Buyer: An individual or company seeking to purchase a product or service offered through the Platform.
  • Seller: Any user who lists or offers a product or service for sale through the Platform.
  • Prospective Client: Any user who expressed interest in a product/service through an inquiry or communication via the Platform.
  • Roaya Gulf Services: Includes all digital products and services provided by the Company through the website (www.roayagulf.com) or its associated applications.
  • We/Us/Company: Refers to Roaya Gulf Information Technology Company, its branches, agents, employees, and related parties.

General Terms

  1. Eligibility and Registration
  • The user must be at least 18 years old.
  • When registering on behalf of a company or entity, the user acknowledges having the legal authority to bind that entity to these terms.
  1. Acceptance and Modifications
  • By using the Platform, the user agrees to these terms and any subsequent updates.
  • The Company reserves the right to amend the terms at any time, and users will be notified of material changes via email or Platform notifications.
  1. User Responsibilities
  • The user undertakes to provide accurate and complete information when registering or listing products/services.
  • The user bears full responsibility for all activities conducted through their account.
  • Compliance with all applicable laws and regulations in the Kingdom of Saudi Arabia is required.
  1. Fees and Payments
  • Fees (listing fees, commissions, services) are determined at the time of use.
  • All fees are non-refundable except in cases expressly stipulated.
  • The user undertakes to pay any applicable fees or taxes (including VAT).
  1. Prohibited Activities
  • Listing illegal, fictitious, or misleading products/services is prohibited.
  • The Platform may not be used for fraudulent purposes, violating laws, or infringing on the rights of others.
  • The Company reserves the right to suspend or delete any non-compliant content without prior notice.
  1. Suspension and Termination
  • The Company has the right to suspend or terminate the account of any user who violates these terms or harms the Platform or its users.
  • The user remains responsible for any outstanding financial obligations up to the point of termination.
  1. Limitation of Liability
  • The Company bears no liability for indirect, incidental, or consequential damages.
  • The Company’s maximum liability is limited to amounts actually paid for the disputed service.
  1. Indemnification
  • The user agrees to indemnify the Company, its employees, and directors against any claims, damages, or expenses arising from breach of terms or misuse of the Platform.
  1. Governing Law and Jurisdiction
  • These terms are subject to the laws of the Kingdom of Saudi Arabia.
  • Saudi courts have exclusive jurisdiction over any disputes arising from them.
  1. Severability
  • If any provision is deemed invalid or unenforceable, the remaining provisions shall remain in effect.

Scope of Services

  • The Roaya Gulf Platform operates as a digital intermediary enabling users to list, sell, and purchase products and services.
  • The Company is not a direct party to any transaction between seller and buyer and provides no warranties regarding the accuracy of information or the validity of listed products/services.
  • It is the buyer’s responsibility to verify the condition of the product/service before completion.

Fees and Commissions

  • Advertising Fees: The seller pays specified fees to list their products or services.
  • Commission Fees: The Company earns a commission upon the successful completion of a sale through the Platform.
  • All fees are non-refundable except in cases expressly stipulated.

Payments and Secure Payment

  • The Company accepts electronic payments via Visa, MasterCard, Mada, Apple Pay, and Google Pay in Saudi Riyals.
  • The Company may provide a secure payment service as an intermediary between buyer and seller, whereby funds are transferred to the seller after completion of ownership transfer or delivery of the product/service.
  • The Company bears no responsibility for financial disputes between parties except regarding its role as a certified intermediary.

Privacy and Data Protection

  • Personal data (name, phone, email, payment details) is collected for the purpose of facilitating transactions and improving services.
  • Data is managed in accordance with the Company’s Privacy Policy available on the Platform.
  • The user has the right to request modification or deletion of their data in compliance with applicable laws.

Force Majeure

The Company bears no responsibility for failure or delay resulting from events beyond its control, such as natural disasters, government decisions, or major technical failures.

Entire Agreement

These terms constitute the complete and final agreement between the user and the Company, superseding any prior agreements or understandings, whether written or verbal.
